Cross-country skiing terms and conditions

1.1. The Seefeld Tourism Association (hereinafter "TVB") operates cross-country ski trails and roller tracks (hereinafter "trails") in the municipal areas of Seefeld, Leutasch, Telfs, Reith bei Seefeld, and Scharnitz, with a total length of over 245 km (partially snow-covered).

1.2. The following general terms and conditions (hereinafter "GTC") between the ticket holder (hereinafter "Guest") and the TVB apply explicitly to the issuance and use of a daily, multi-day, annual or any other ticket for the trails (hereinafter "ticket"). The ticket is issued exclusively under these GTC, which are deemed accepted at the latest upon first use of the ticket or any of the trails.

2.1. By using a ski trail, a service contract is established exclusively between the guest and the TVB. If other service partners enter into a contractual relationship (briefly referred to as "service contracts") with the guest, any applicable terms and conditions or conduct rules of such service partners may also apply.

2.2. The guest has no claims of any kind against the TVB arising from the service contracts concluded with other service partners, particularly due to non-performance by these service partners; in particular, this includes no claims for fulfillment, warranty, and damages.

3.1. During the winter season, the cross-country skiing trails are generally in operation from November of one year until April of the following year.

3.2. The operation of the roller track and the snow farming trail depends on the prevailing weather conditions, and therefore the TVB reserves the right to specify the start of operation on a case-by-case basis.

3.3. Depending on the weather and snow conditions, the periods during which the trails are in operation and therefore usable (short "season") may be shortened or extended accordingly. The guest cannot derive any claims of any kind against the TVB from this, especially no claims for fulfillment, warranty, and damages.

3.4. The trails are in operation daily from 09:00 AM to 04:30 PM during the season.

3.5. The night trail in Seefeld is open during the winter season from Monday to Friday from 05:00 PM to 08:30 PM. Please note that from Monday to Friday, between 04:30 PM and 08:30 PM, there is no trail service and no trail rescue on the night trail. In the event of an accident during this period, emergency services will be alerted by the Tirol control center. The roller track (3.6 km) in Seefeld is accessible during the summer season; exact opening times and information can be obtained from the operating company Seefeld Sports.

3.6. The TVB reserves the right to set the seasons and daily opening times differently from these terms and conditions. The guest cannot derive any claims of any kind against the TVB from this, especially no claims for fulfillment, warranty, and damages.

3.7. The TVB also reserves the right to partially or completely close the trails for organizational or technical reasons or due to weather; this especially for the execution of events or preparation work as well as for rescue services. The guest cannot derive any claims of any kind against the TVB from this, especially no claims for fulfillment, warranty, and damages.

4.1. The validity period depends on the type of card and can be directly inferred from the respective card.

4.2. Regarding the annual pass, reference is made to point 11 of these terms and conditions.

5.1. All types of passes must be purchased before using the trails and can optionally be obtained at designated sales points, the designated machines, or online at www.seefeld.com.

5.2. Designated sales points will be announced on the homepage www.seefeld.com and can be accessed there. These include in particular offices of the TVB, sports shops, and accommodations.

The prices of the various tickets are announced on the homepage www.seefeld.com and can be retrieved there.

7.1. Every guest with a valid card is entitled to use the trails provided by the TVB in accordance with the provisions of these GTC. The included trails can be queried in the available trail map/overview and on the homepage www.seefeld.com.

7.2. By presenting a valid card and wearing cross-country skiing equipment, the use of regional buses in the Seefeld region and also the train (additional presentation of an ÖBB usage card required, available free of charge at the Seefeld and Leutasch information offices) between Innsbruck and Scharnitz (and return) is included during the cross-country skiing season (as long as trails are groomed).

7.3. The TVB is entitled to terminate agreements with guests for important reasons even during the validity period of the card. The TVB is then no longer obliged to recognize the cards and allow trail usage. The guest cannot derive any claims of any kind against the TVB from this, especially no claims for performance, warranty, or damages.

7.4. The card contains no insurance benefits. For any insurance coverage, the guest must arrange it at their own expense.

8.1. The TVB and its contractual partners are entitled, but not obligated, to make snow on the slopes or groom them and to maintain them at any time – even during the daily opening hours of the slopes.

8.2. For this purpose, the TVB can use snow cannons, slope grooming machines, snowmobiles, quads, and the like at any time.

8.3. After weather caprices – such as heavy rain or snowfall – the restoration of parts of the slope system may take several days, making its usability impossible.

8.4. The guest cannot derive any claims of any kind, particularly not for fulfillment, warranty, and damages, from the fact that the slopes cannot be used at all or only to a limited extent due to snowmaking, grooming, or other maintenance work, or due to force majeure (pandemics, epidemics, natural disasters, etc.).

8.5. The guest has no right to demand that the slopes be snow-covered or groomed.

9.1. The ski trails may only be used with a valid card, during the season, and within daily opening hours – unless they are closed. Tickets must be purchased before using the trails; in case of violation, the guest is obliged to pay a penalty of € 190.00; this also applies if the guest is found without a valid trail ticket. Vouchers do not count as valid ticket types. Vouchers must be exchanged for a valid card (see section 11) at authorized locations (namely, the TVB offices) prior to using the trails.

9.2. After dark, the guest must provide sufficient lighting themselves, either by using a headlamp or similar device. This is generally not necessary for night trails. Outside of opening hours, the use of the trails – even with headlamps – is strictly prohibited.

9.3. The guest must exercise the care of a cautious and reasonable cross-country or roller skier while using the trails. Weather conditions, trail conditions, and snow conditions must be taken into account; the guest must adjust accordingly.

9.4. In particular, the guest must pay necessary attention to recognize snowmaking and grooming activities in time. Even during ongoing snowmaking and grooming activities, the guest must exercise the necessary care.

9.5. Temporary or permanent signage must be observed by the guest and their behavior must be adjusted accordingly.

9.6. The rules of the "Federation Internationale De Ski", the so-called FIS rules, apply on the trails. These can be accessed here.

9.7. Cross-country skiing and roller skiing outside of the groomed trail is generally not permitted. However, guests may use designated rest areas and proceed directly to them (but not against the prescribed direction of travel).

9.8. Suitable trails for wheelchair users/sled skiers are marked on the trail map or overview as well as on www.seefeld.com.

9.9. When using a trail, the guest is required to present the card to the authorized staff from the TVB upon request. If the guest cannot or does not want to do this, the TVB may refuse the use of the trail – without affecting the guest's obligation to pay the penalty.

9.10. The TVB can refuse trail usage for justified reasons. Reasons for refusal include: natural events and other cases of force majeure, maintenance work, repairs, threats to personal safety, threats to others, overcrowding, poor health condition of the guest, inadequate equipment of the guest, inappropriate clothing of the guest, violations of TVB regulations, or similar reasons. The guest cannot derive any claims of any kind against the TVB from this, particularly no claims for fulfillment, warranty, or damages.

9.11. In cases of abuse or suspicion of abuse, the TVB has the right to confiscate the card without compensation and possibly block it. In cases of proven abuse or substantiated suspicion of abuse, a police report will be filed. The guest cannot derive any claims of any kind against the TVB from this, particularly no claims for fulfillment, warranty, or damages.

9.12. The presence of dogs on the trail is generally prohibited, except for those explicitly designated as dog trails.

The TVB is liable to the guest only in cases of intent and gross negligence. This limitation does not apply to personal injury. If, in individual cases, a broader exclusion of liability is legally permissible, it is hereby also deemed to be agreed upon.

11.1. The annual pass is valid from the date of purchase - but at the earliest from September 1st of one year until August 31st of the following year.

11.2. The use of the regional buses in the Seefeld region and the train between Innsbruck and Scharnitz (and back) is included in the annual pass for the purpose of cross-country skiing with appropriate equipment until the end of the trail season. Any additional voluntary inclusions will be announced at www.seefeld.com. Holders of free tickets are entitled to use the entire trail network, but are not allowed to take advantage of the remaining inclusions of the trail & roller track annual pass.

11.3. The annual pass must contain the name of the guest or the institution (e.g. ski school / club). Additionally, a photo of the guest must be visible on the annual pass. Verification of the annual pass may require the presentation of a photo ID. A current digital version of the annual pass (only including the card number, QR code, name, and date of birth of the cardholder) which is sent to the email address provided by the guest is also valid. Coupons do not count as valid card types. Before using the trails, coupons must be redeemed or exchanged at authorized locations (i.e. the TVB offices) for a valid card.

11.4. The annual pass is non-transferable and may only be used by the person to whom the card is issued.

11.5. The transfer of the annual pass is not permitted. In the event of transfer of the annual pass, the guest is also liable for any misuse of the annual pass by third parties.

11.6. Theft or loss of the annual pass must be reported immediately to the TVB. The report can be made by phone at +43 (0) 50880 or via email to region@seefeld.com. The TVB can then issue a new card for a fee. The lost card will be blocked upon the issuance of a new card and thus loses its validity.

11.7. In the event of severe illness or an accident, the costs of the annual pass will be refunded by the TVB on a pro-rata basis upon appropriate verification via a credit for the following year. The amount of the refund is based on the number of days the annual pass cannot be used due to illness or accident. The tiers are as follows: 100% until the end of December, 50% until the end of January, and 20% until the end of February, after which no refund will be made. Cash payments are not possible. A prerequisite for the refund is the presentation of a certificate from a doctor or hospital in the region. In justified cases, the TVB also accepts certificates from doctors and hospitals outside the region. The documentation must be submitted - including the original annual pass - by the end of April of the respective winter at the latest.

11.8. Please note the applicable regulations for Tyrol as well as any Covid-related restrictions/guidelines before purchasing the trail & roller track annual pass.

11.9. The mere non-use of the annual pass or the trails does not establish any entitlement to a refund.

11.10. For the issuance and subsequent use of the annual pass, the TVB collects, stores, and processes the first name, last name, date of birth, address, email address, photo, and validity period of the guest's annual pass (hereinafter "personal data"). The personal data is required for verifying the guest's usage entitlement as well as for pursuing potential claims of the TVB and thus, in accordance with § 8 Abs 3 Z 4 DSG 2000 and Art 6 Abs 1 lit b GDPR, is necessary for contract fulfillment. To process potential mutual liability claims, the personal data will be stored for three years from the respective end of the validity period and subsequently deleted.

11.11. The TVB reserves the right to permanently store and use the guest's first name, last name, address, and email address for its own advertising purposes in aggregated lists in accordance with § 107 Abs 3 of the Telecommunications Act (TKG) and in accordance with Art 6 Abs 1 lit f GDPR for sending interesting offers and information about services and offers of the TVB by mail or email. The guest can object to this processing of data when collected as well as at any time thereafter by sending an email to region@seefeld.com.

11.12. Unless required for contract processing, the personal data of the guest will not be shared with third parties. Required for contract processing may be, in particular, the transfer of data to the TVB's contractual partners if they need the personal data in connection with the verification and fulfillment of their contractual obligations. The transfer to a collection agency or lawyer may also be necessary.

11.13. The guest has the right to information about the personal data concerning him, data portability, the rectification or deletion of personal data, and the restriction of the processing of his personal data or to raise an objection against it. The guest can exercise these rights by emailing region@seefeld.com.

11.14. Finally, the guest has the right to lodge a complaint with the Austrian Data Protection Authority (Hohenstaufengasse 3, 1010 Vienna, dsb@dsb.gv.at, www.dsb.gv.at).

12.1. There are no verbal side agreements to these terms and conditions. Any kind of side agreements as well as changes or additions require written form to be effective. This also applies to any deviation from this written form requirement.

12.2. For any possible claims arising from the use and issuance of the card, the exclusive applicability of Austrian law is agreed upon, excluding the UN Sales Convention and the Austrian reference norms of Austrian international private law.

12.3. Notwithstanding mandatory statutory provisions, the competent court for all legal disputes between the TVB and the guest is expressly agreed to be the court competent for 6100 Seefeld; the TVB has the right to sue the guest at any other statutory court jurisdiction.

12.4. If one or more provisions of these terms and conditions are invalid, it is expressly agreed between the TVB and the guest that valid provisions shall apply, which come closest to the economic purpose of the invalid provision. The validity of the remaining provisions is not affected by an invalid provision.

12.5. In the case of recovery/transport by the slope rescue team, you will receive an invoice for a flat fee of €150.00, which is to be paid via bank transfer. Generally, you can submit this invoice to your insurance. To get reimbursed for such costs, it is advisable to take out the Mountain Rescue Sponsorship Insurance for winter sports activities, for example.
